ARTICLE IV - HOME TERRITORY

4.1 Home Territory Defined.
- "Home Territory" with respect to any club means the area in which the club is located and for which it holds a franchise and plays its home games.

4.2 Rights Within Home Territory.
- Other than League Championship games and audio and visual reproduction rights granted to the League, each member has the exclusive right within its home territory to exhibit professional football games played by teams of the League except that:
- (a) Whenever two (2) club franchises in the League are located in the same area, then the owners of each of such franchises have equal rights within the home territory of the area.
- (b) Subject to the provisions of Section 4.2 (a) above, no club in the League may play games within the home territory of any other club unless a home club is a particlpant.
- (c) No member has any right to transfer its club or franchise to a location outside of its home territory except upon the affirmative vote of three-fourths (3/4) of the member clubs, including the affirmative vote of any member club whose home territory would be affected by the proposed transfer.

4.3 League Control of Games.
- The League has exclusive control of the exhibition of football games by member clubs within the home territory of each member.  No member club has the right to transfer its franchise or playing site to a different area, either within or outside its home territory, without prior approval by the affirmative vote of three-fourths (3/4) of the existing member clubs of the League, including the affirmative vote of any member club whose home territory would be affected by the proposed transfer. This provision shall not restrict a club's right to change the location of its business office within the club's home territory.

4.4 Conference Alignment.
- The League will be divided into such conferences and divisions as shall be adopted by the members through the By-Laws.

4.5 Conference Alignment Considerations.
- Subject to the provisions of the By-Laws, whenever the League proposes or seeks to realign the clubs into conferences or other groups for scheduling or standing purposes, certain factors will be considered in order not to unfairly prejudice the rights of any club in the League, including geographical location and proximity, natural rivalries, stadium capacity, gate attendance, weather conditions, relative team strength, and other sport conflicts involving clubs playing home games in sports facilities.
