ARTICLE X - BROADCASTING AND TELEVISION

10.1 Authority to Contract.
- The Commissioner, pursuant to Section 8.9, has the exclusive right to negotiate and enter into contracts for the visual reproduction of any and all League games.  He may employ such persons as are necessary to effectuate this Article X.

10.2 Audio/Visual Reproduction Income.
- All regular season and pre-season audio and/or visual reproduction rights and income, except local radio, will be divided equally among all member clubs of the League regardless of the source of such income, except that the member clubs may, by unanimous agreement, provide otherwise in a specific contract or contracts.

10.3 Local Radio Broadcasts.
- Each member club has the right to negotiate and enter into contracts for the local radio broadcasting of all pre-season and regular season games by a station located in or serving its home territory.

- (a) Each home club does hereby grant to the visiting club the exclusive right to permit or license the broadcast of the game being played between them back to the home territory of the visitinq club.
- (b) Any contract entered into by a club for the radio broadcast of its games, and the sponsor or sponsors for the radio broadcast, must be approved in writing by the Commissioner in advance of the broadcast.

10.4 Championship Games
- The sale of audio, visual, and film reproduction rights, or any combination thereof, for the Championship Games or other post-season play, shall be under the sole jurisdiction of the Commissioner and is subject to the provisions of Article X.  In the Championship Games, the participating clubs may broadcast by local radio on a non-exclusive basis from a station located in or serving its home territory, if (1) the club contributes to the gross receipts of the came (to be divided in the same manner as game receipts are distributed) a fair and equitable sum fixed by the Commissioner in his role and absolute discretion; and (2) provided the Commissioner approved all sponsors and broadcasters involved in the game.

10.5 Broadcast Facilities.
- If required by a League media contract, each club when playing at home shall provide adequate space for use of the visiting club in broadcasting each game.

10.6 Player Depiction and Club Promotion.
- All players, coaches, and other employees, and all League officers and employees, grant to the club controlling their contracts, and to the League severally and jointly, or to the League only in the case of League employees, the privilege and authority to use their names and/or pictures for publicity and/or advertising purposes in newspapers, magazines, motion pictures, game programs and annual roster manuals, radio material, audio and visual reproduction, and all other publicity and/or advertising media, provided such publicity and/or advertising does not in itself constitute an endorsement by any individual player, coach, or employee of a commercial product.

10.7 Scoreboard Replays.
- In all USFL stadiums with the capability of displaying visual replays of action occurring on the field, such displays may be shown at any time during the game, provided, however, that the selection of material for the replays shall be at the home club' s discretion.

10.8 Licensing Corporation.
- If the Members decide to grant to a corporation or other organization any or all of the rights to sublicense the reproduction of any visual images and/or sounds, or other reproduction rights, the capital stock or other equity interest in the corporation or other organization must be equally owned by the Members, and any agreements relating to the ownership must make provisions for changes in the ownership to coincide with the addition of Members, terminations of membership, and transfers of membership.
